Terms of Service

Effective September 17, 2026

These Terms of Service ("Terms") govern your access to and use of the CIV hydraulic design platform and related websites and services (collectively, the "Service") operated by 104Engineering, LLC ("104Engineering", "we", "our", or "us").

By creating an account, requesting demo access, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

1. Definitions

• Service: the CIV platform, including the design and analysis tools, calculation engine, reports and exports, API, and documentation.
• Account: a registered user account (Pioneer, Professional, or other tier).
• Demo Access: time-limited, email-verified access without an account or export features.
• Content: inputs, project data, and results you create or upload.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. The Service is a professional engineering tool intended for use by qualified professionals. By using it, you represent that you are using it in a professional or educational capacity.

3. Accounts and Registration

Account creation may require an invitation code. You agree to provide accurate information, keep your password confidential (passwords are stored only as bcrypt hashes), and accept responsibility for activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• reverse engineer, scrape, or attempt to extract the calculation engine or source code;
• resell, sublicense, or provide the Service to third parties except as permitted by your plan;
• circumvent authentication, rate limits, usage caps, or security controls;
• upload unlawful content or use the Service to violate any law or third-party right;
• overload or disrupt the Service or its infrastructure.

We employ security monitoring and may rate-limit, ban, or block abusive access.

5. Engineering Disclaimer

The calculation engine is validated against published FHWA HDS-5 reference cases but is expressly not a substitute for a licensed engineer's independent review and stamp. You are solely responsible for verifying all outputs before any professional or construction use. See also our Documentation & Legal Disclaimer.

6. Subscriptions, Billing, and Renewal

Paid tiers are billed on a recurring basis (currently monthly) at the price shown at checkout. Subscriptions auto-renew at the end of each billing period until cancelled. You authorize us and our payment processor (Stripe, Inc.) to charge your payment method for each renewal. Payment card data is handled solely by Stripe and never stored on our servers.

You may cancel at any time; cancellation stops future renewals, and access continues through the end of the current paid period. Prices may change with reasonable prior notice to registered users.

7. Refund Policy

Refunds are available within 30 days of your first charge, provided you have run fewer than 10 calculations or exported fewer than 3 PDFs. Accounts with significant usage are not eligible for a full refund but may be considered for a prorated credit at our discretion. Refunds are requested by contacting us (see Contact below) and are processed manually.

8. Intellectual Property

The Service, including the calculation engine, software, visual design, and documentation, is the proprietary property of 104Engineering, LLC and is protected by law. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of your Content; you grant us a limited license to process and store it solely to operate the Service.

9. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your requirements.

10. Limitation of Liability

To the maximum extent permitted by law, 104Engineering and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or professional-liability claims, arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or USD $100 if you paid nothing.

11. Indemnification

You agree to indemnify and hold harmless 104Engineering and its owner from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your Content, or your violation of these Terms or of any law or third-party right.

12. Termination

We may suspend or terminate your access at any time for violation of these Terms or for conduct that risks harm to the Service or other users. You may stop using the Service at any time. Upon termination, your right to use the Service ceases; data is retained or deleted per the Privacy Policy.

13. Changes to These Terms

We may update these Terms. Material changes will be indicated by a revised version and effective date on this page, and we will make reasonable efforts to notify registered users. When a material change occurs, we may require you to re-accept the updated Terms. Continued use after the effective date constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of the state in which 104Engineering, LLC is organized, without regard to conflict-of-laws principles. Venue and dispute-resolution provisions are set out in the current version of these Terms.
